1. Agreement to terms
These Terms and Conditions govern your access to and use of fakeimagesdetector.com and the image analysis tool it hosts (together, the "Service"). By accessing or using the Service you agree to be bound by these terms. If you do not agree, do not use the Service.
2. What the Service is
The Service provides heuristic, client-side image forensics. It analyses an image you supply and returns indicative signals — an authenticity score, a per-layer breakdown, an error level analysis map and a colour histogram — intended to assist human judgement.
The Service does not certify authenticity. Its output is an analytical indicator, not proof, not an expert opinion and not a legal determination.
3. Licence to use
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for lawful personal or professional purposes, subject to these terms. No fee is charged and no account is required.
4. Acceptable use
You agree that you will not:
- Use the Service to analyse material you have no legal right to possess or process.
- Analyse child sexual abuse material, or any content whose possession is unlawful in your jurisdiction.
- Misrepresent the Service's output — for example presenting a score as a certified or court-admissible finding.
- Use results to harass, defame, discriminate against or endanger any person.
- Attempt to disrupt, overload, reverse engineer for the purpose of circumvention, or gain unauthorised access to the Service or its infrastructure.
- Scrape, republish or commercially redistribute the Service or substantial parts of it as your own product without written permission.
Because analysis runs entirely in your browser, you retain full responsibility for the legality of the material you choose to process.
5. Your content
You retain all rights in the images you analyse. We claim no licence over them, and could not exercise one if we did — they are never transmitted to us. You are solely responsible for ensuring you hold the necessary rights and permissions for any image you process.
6. Intellectual property
The Service — including its interface, source code, design system, text, graphics, logos and detection methodology — is owned by us or our licensors and is protected by intellectual property law. The name and branding of the Service may not be used without written permission.
7. Availability and changes
The Service is provided on an "as available" basis. We may modify, suspend or discontinue any part of it at any time, with or without notice. Detection heuristics may change as manipulation techniques evolve, and results produced at different times may therefore differ.
8. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including without limitation any warranties of merchantability, fitness for a particular purpose, accuracy, reliability or non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or that any result it produces is accurate, complete or suitable for your purpose. Detection of image manipulation is inherently probabilistic: false positives and false negatives will occur.
9. Limitation of liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for any loss of profits, revenue, data, goodwill or reputation, arising out of or relating to your use of — or inability to use — the Service, including any decision made in reliance on its output.
Where liability cannot lawfully be excluded, our total aggregate liability shall not exceed one hundred US dollars (US$100) or the amount you paid us for the Service in the preceding twelve months, whichever is greater. Since the Service is free, that amount is ordinarily zero.
Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded under applicable law.
10. Indemnity
You agree to indemnify and hold us harmless from any claim, demand, loss or expense (including reasonable legal fees) arising from your use of the Service, your breach of these terms, or your reliance on or publication of any result produced by the Service.
11. Third-party links and services
The Service may link to or load resources from third parties. We do not control and are not responsible for their content, policies or practices.
12. Governing law and disputes
These terms are governed by the laws applicable at our principal place of business, without regard to conflict-of-law rules. You agree to attempt to resolve any dispute informally by contacting us first; unresolved disputes shall be subject to the exclusive jurisdiction of the courts of that location.
13. Severability and entire agreement
If any provision of these terms is held unenforceable, the remaining provisions remain in full force. These terms, together with our privacy policy and disclaimer, constitute the entire agreement between you and us regarding the Service.
14. Changes to these terms
We may revise these terms at any time by posting an updated version. Your continued use of the Service after changes are posted constitutes acceptance of the revised terms.
